Terms of Service

These Terms of Service ("Terms") govern your use of the RunQuest mobile application and website at https://runquest.io, operated by Zach Highley LLC ("we," "us," "our"). By using RunQuest, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use RunQuest. By using the app, you represent that you meet this requirement.

2. Account & Authentication

You may use RunQuest with a device-level session or sign in with Apple or Google. You are responsible for maintaining the security of your account credentials. We are not liable for any loss resulting from unauthorized access to your account.

3. Subscriptions & Payments

RunQuest may offer free and paid subscription tiers. Paid subscriptions are processed through Apple's App Store and are subject to Apple's terms and pricing.

  • Subscription billing is managed entirely by Apple. Refund requests should be directed to Apple.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription in your iPhone's Settings under Subscriptions.
  • We reserve the right to change pricing with reasonable notice. Price changes do not affect active billing periods.

4. Acceptable Use

You agree not to:

  • Use RunQuest for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to reverse-engineer, decompile, or extract the source code of the app or backend services.
  • Interfere with or disrupt the app, servers, or networks connected to RunQuest.
  • Abuse, harass, or attempt to manipulate the AI coaching system in ways that circumvent safety rules.
  • Use automated means (bots, scrapers) to access RunQuest services beyond normal app usage.
  • Share your account credentials or API keys with others.

5. Health & Fitness Disclaimer

RunQuest is not medical advice and is not a substitute for professional medical guidance.

  • AI coaching cues are motivational and informational. They are not medical diagnoses, treatment plans, or professional fitness prescriptions.
  • Heart-rate coaching is optional and conservative. RunQuest uses general formulas (e.g., age-based max HR estimates) and cannot account for individual medical conditions.
  • Before starting or changing any exercise or training program, consult a qualified physician or clinician.
  • You assume full responsibility for your physical activity while using RunQuest. Stop exercising immediately if you feel pain, dizziness, or discomfort.

6. Intellectual Property

RunQuest, its name, logo, design, and content are the property of Zach Highley LLC. You may not use our trademarks or branding without written permission.

Content you create (notes, goals, coach interactions) remains yours. You grant us a limited license to process this content as needed to provide the service.

7. Third-Party Services

RunQuest integrates with third-party services including Apple HealthKit, Strava, OpenAI, Sentry, PostHog, and RevenueCat. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or conduct of third-party services.

8. Limitation of Liability

To the maximum extent permitted by law, Zach Highley LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of RunQuest. This includes, without limitation, damages for personal injury, lost data, or interruption of service.

Our total liability for any claim related to RunQuest shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

9. Disclaimer of Warranties

RunQuest is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

10. Termination

We may suspend or terminate your access to RunQuest at any time for violation of these Terms or for any other reason with reasonable notice. You may stop using RunQuest at any time. Upon termination, you may request deletion of your data as described in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the State of Pennsylvania, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Pennsylvania.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a revised effective date. Continued use of RunQuest after changes constitutes acceptance of the updated Terms.
